Terms of Service

Turnsday is intended for individuals who are 18 years of age or older.

By using the Service, you represent and warrant that:

• You are at least 18 years old;
• You have the legal capacity to enter into these Terms;
• The information you provide to us is accurate and up to date; and
• Your use of the Service complies with applicable laws and regulations.

Turnsday is not intended for children or individuals under 18.

Turnsday is a personal birthday and gift-planning service designed to help you remember important birthdays and discover gift ideas.

Depending on your plan and available features, the Service may allow you to:

• Create and manage your Turnsday account;
• Add information about people you know, including their name, date of birth, age, and optional photo;
• Receive birthday reminder emails based on settings you choose;
• Receive AI-generated gift suggestions;
• Discover products available through third-party retailers, including Amazon; and
• Access other features that we may introduce or modify from time to time.

We may add, modify, suspend, or discontinue features of the Service from time to time.

You may create and maintain one Turnsday account.

You are responsible for:

• Providing accurate and complete account information;
• Keeping your login credentials secure;
• All activity occurring through your account; and
• Notifying us if you believe your account has been accessed without authorization.

You may sign in using supported authentication methods, including email or Google authentication. You may not create an account using another person’s identity or information, or use the Service on behalf of another person without authorization.

Turnsday may offer a free trial to eligible users.

If a free trial is available, the applicable trial duration, eligibility requirements, and any additional terms will be displayed during signup or checkout. Unless otherwise stated at the time of signup, a free trial may require valid payment information and may automatically convert into a paid plan when the trial period ends.

You are responsible for reviewing the applicable trial terms before starting a free trial. You may cancel before the end of the trial period to avoid being charged for the applicable paid plan. We reserve the right to determine eligibility for free trials and to limit, suspend, or withdraw trial offers where permitted by law.

Turnsday currently offers the following paid access options:

Monthly Plan — $9.99 per month. The Monthly Plan automatically renews each month unless cancelled before the next renewal date.

Yearly Plan — $29.99 per year. The Yearly Plan automatically renews each year unless cancelled before the next renewal date.

Lifetime Access — $347 one-time payment. Lifetime Access is a one-time, non-renewing purchase and does not require recurring subscription payments. “Lifetime Access” means access to the applicable paid Turnsday features for the lifetime of the Turnsday Service, subject to these Terms and any applicable law.

We do not guarantee that every feature currently available will remain available indefinitely. We may modify or discontinue features as described in these Terms. Prices may change for future purchases. If a price change affects an existing recurring subscription, we will provide any notice required by applicable law.

Payments are processed by third-party payment providers, including Stripe. Turnsday does not store your complete payment card number.

By purchasing a paid plan, you authorize the applicable payment provider to charge the payment method associated with your purchase according to the selected billing terms. For recurring plans, charges will continue automatically until you cancel your subscription.

If a payment fails, we may attempt to collect the outstanding payment through the applicable payment provider and may suspend or restrict access to paid features until the payment issue is resolved.

You may cancel a recurring subscription at any time through the cancellation functionality in your Turnsday account. Cancelling a subscription stops future automatic renewals.

Lifetime Access does not renew and does not require cancellation.

When you delete your Turnsday account, your access ends immediately and any active recurring subscription is cancelled immediately. Your personal data — the people on your list, saved gift ideas, reminder settings, your profile, and photos — is deleted. Certain payment and transaction records may be retained where required by law or for legitimate accounting, security, or dispute-handling purposes.

Deleting your account does not automatically entitle you to a refund. Refunds are governed by Section 8 (Refunds) and by mandatory applicable law.

You may request a full refund within 7 days of any payment. This applies to all plans — Monthly, Yearly, and Lifetime Access.

After the first 7 days, payments are non-refundable, including after account deletion and including Lifetime Access, except where mandatory applicable law requires otherwise.

Refund requests are reviewed and processed manually by our support team and are not automatic. To request a refund within the 7-day window, contact us at contact@turnsday.com. Approved refunds are generally returned to your original payment method; the time for the refund to appear may depend on your bank, card issuer, or payment provider.

Nothing in this section limits any refund or consumer rights that cannot legally be excluded or waived under applicable law.

Turnsday allows you to configure birthday reminder notifications.

Available reminder options are: 30 days, 15 days, 7 days, 3 days, and 1 day before a birthday. Turnsday does not send a reminder on the birthday itself.

Reminders are delivered by email, and we do not guarantee that every reminder will be delivered at the exact intended time. Delivery may be affected by email providers, spam filters, technical issues, outages, incorrect email addresses, or other circumstances outside our reasonable control.

Turnsday allows you to store information about people you know, such as their name, birthday, age, and optional photo. You are responsible for ensuring that your collection and submission of information about other individuals is lawful and appropriate in your circumstances.

You should not provide information that you are not authorized or otherwise legally permitted to provide. You also agree not to use Turnsday to collect or store information for unlawful, abusive, discriminatory, fraudulent, or harmful purposes. For information about how we handle personal information, please review our Privacy Policy.

Turnsday includes an AI-powered gift-suggestion feature that generates gift ideas based on information you provide and the context of your request. These suggestions are provided for informational and inspirational purposes only.

AI-generated suggestions may be:

• Inaccurate;
• Incomplete;
• Outdated;
• Unavailable;
• Unsuitable for a particular recipient; or
• Based on incorrect assumptions.

The feature may make mistakes. You are responsible for independently evaluating any suggestion before relying on it or making a purchase. Turnsday does not guarantee that a suggestion will be appropriate, available, affordable, or suitable for a particular person, and does not provide professional advice through this feature.

Turnsday may display product recommendations or links to products offered by third-party retailers, including Amazon. Turnsday is not the seller, manufacturer, distributor, or fulfillment provider for products offered through third-party retailers.

We do not control or guarantee:

• Product quality;
• Product safety;
• Product availability;
• Product pricing;
• Product descriptions;
• Shipping or delivery;
• Returns or refunds;
• Warranties;
• Customer service; or
• The performance of any third-party seller or retailer.

Any purchase you make through a third-party retailer is subject to that retailer’s applicable terms, policies, and conditions. Turnsday is not responsible for disputes between you and a third-party retailer or seller.

Turnsday participates in affiliate programs, including the Amazon Associates program. When you purchase qualifying products through certain affiliate links, Turnsday may receive a commission at no additional cost to you.

As an Amazon Associate I earn from qualifying purchases.

Affiliate relationships do not determine whether a product is suitable for you. You should independently evaluate products before purchasing them.

You retain ownership of information, photos, and other content that you submit to Turnsday, subject to the rights necessary for us to operate the Service. By submitting content to Turnsday, you grant us a limited, non-exclusive right to host, store, process, display, and otherwise use that content only as reasonably necessary to provide, maintain, secure, and improve the Service and as described in our Privacy Policy.

You represent that you have the necessary rights or authorization to submit the content you provide to Turnsday.

The Service and its underlying technology, design, software, branding, trademarks, logos, text, graphics, interfaces, and other materials provided by Turnsday are owned by or licensed to Turnsday and are protected by applicable intellectual property laws.

Except as expressly permitted by these Terms, you may not:

• Copy, reproduce, modify, or distribute the Service;
• Reverse engineer or attempt to extract source code;
• Create derivative works from the Service;
• Sell, sublicense, lease, or commercially exploit the Service;
• Remove proprietary notices;
• Use Turnsday branding without permission; or
• Attempt to gain unauthorized access to the Service or its systems.

Your use of the Service does not transfer ownership of Turnsday’s intellectual property to you.

You agree not to use Turnsday to:

• Violate any applicable law or regulation;
• Commit fraud or facilitate fraudulent activity;
• Harass, abuse, threaten, or harm another person;
• Attempt unauthorized access to accounts, systems, or data;
• Interfere with the operation or security of the Service;
• Circumvent payment requirements or access restrictions;
• Scrape, crawl, or systematically extract data from the Service without authorization;
• Introduce malware, viruses, or other harmful code;
• Reverse engineer the Service;
• Use automated systems to abuse or overload the Service;
• Impersonate another person or entity; or
• Use the Service for any purpose that is unlawful or prohibited by these Terms.

Turnsday relies on certain third-party services to operate the Service. These may include payment processors, hosting providers, email providers, authentication providers, cloud storage and caching providers, AI providers, error-monitoring services, and third-party retailers.

Your use of certain third-party services may be subject to the third party’s own terms and privacy policies. We are not responsible for the acts, omissions, availability, policies, or performance of third-party services.

Your use of Turnsday is also governed by our Privacy Policy, which explains how we collect, use, disclose, retain, and protect information associated with your use of the Service. You can review the Privacy Policy on our website.

We aim to keep Turnsday available and reliable, but we do not guarantee that the Service will always be available, uninterrupted, secure, or error-free. The Service may occasionally be unavailable due to:

• Maintenance;
• Updates;
• Technical failures;
• Security incidents;
• Third-party service interruptions;
• Internet or telecommunications failures; or
• Circumstances beyond our reasonable control.

We may temporarily suspend access when reasonably necessary to protect the Service, our users, or our systems.

You may stop using Turnsday at any time and may delete your account through the available account functionality. We may suspend or terminate your access to the Service if we reasonably believe that:

• You have violated these Terms;
• You have engaged in fraudulent or abusive activity;
• Your use creates a security or legal risk;
• Your payment obligations remain unresolved;
• We are required to do so by law; or
• Suspension or termination is otherwise reasonably necessary to protect Turnsday, its users, or third parties.

Where appropriate and reasonably practicable, we may provide notice before taking action. Termination does not eliminate obligations or liabilities that arose before termination.

To the maximum extent permitted by applicable law, Turnsday is provided on an “as is” and “as available” basis. We do not guarantee that:

• The Service will meet every user's requirements;
• The Service will always be available;
• Information provided through the Service will always be accurate or complete;
• AI-generated suggestions will be accurate or suitable;
• Birthday reminders will always be delivered successfully or on time;
• Third-party products will remain available;
• Product prices or information will remain accurate; or
• The Service will be completely free from errors, interruptions, or security vulnerabilities.

Nothing in these Terms excludes warranties, rights, or protections that cannot legally be excluded under applicable law.

To the maximum extent permitted by applicable law, Turnsday and its owners, officers, employees, contractors, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of, or inability to use, the Service. This includes, where permitted by law, losses relating to lost profits, lost revenue, lost data, business interruption, third-party products or services, reliance on AI-generated suggestions, or unauthorized access resulting from circumstances outside our reasonable control.

To the maximum extent permitted by applicable law, Turnsday’s total aggregate liability arising out of or relating to the Service or these Terms will not exceed the greater of (1) the amount you paid to Turnsday for the Service during the six (6) months preceding the event giving rise to the claim, or (2) $100 USD.

Nothing in these Terms limits liability that cannot legally be limited or excluded under applicable law.

To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Turnsday and its owners, officers, employees, contractors, affiliates, and service providers from claims, liabilities, damages, losses, and expenses arising from your violation of these Terms, your unlawful use of the Service, content you submit to the Service, your violation of another person’s rights, or your use of the Service in a manner that violates applicable law.

This section does not require you to indemnify Turnsday for losses caused by Turnsday’s own unlawful conduct where such indemnification would not be permitted by applicable law.

We may modify, improve, add, remove, suspend, or discontinue features of the Service at any time. If we make material changes to the Service or these Terms, we may provide notice through the Service, by email, or by other reasonable means where required by applicable law. Your continued use of the Service after the effective date of updated Terms constitutes acceptance of the updated Terms, to the extent permitted by applicable law.

We may update these Terms from time to time. When we make changes, we will update the “Last updated” date at the top of these Terms. If a change is material, we may provide additional notice where appropriate or required by law. If you do not agree with updated Terms, you should stop using the Service and cancel any applicable recurring subscription.

These Terms are governed by the laws of the State of Montana, USA, without regard to its conflict-of-law principles, subject to any mandatory consumer-protection laws that apply to you. Nothing in these Terms prevents you from exercising rights or remedies that cannot legally be waived.

Informal resolution first

If you have a dispute with us, please contact us first at contact@turnsday.com so we can try to resolve it informally. Most concerns can be settled this way, and we ask that you give us a chance to do so before starting a formal proceeding.

Binding arbitration

If we can’t resolve a dispute informally, you and Turnsday agree that it will be resolved by final and binding individual arbitration, rather than in court, except as stated below. The arbitration will be administered under the Commercial Arbitration Rules of the American Arbitration Association (AAA), and may take place in Montana or be conducted remotely. By agreeing to arbitration, you understand that you and Turnsday are each giving up the right to a trial in court and to a jury.

No class actions

Disputes will be handled only on an individual basis. To the fullest extent permitted by law, you and Turnsday agree not to bring or take part in any class, collective, or representative action.

Exceptions

Either party may bring a claim in small-claims court, and either party may ask a court for an order to protect its intellectual property or stop misuse of the Service. These exceptions are not subject to arbitration.

Opt out of arbitration

You may opt out of this arbitration agreement by emailing us at contact@turnsday.com within 30 days of first accepting these Terms. If you opt out, disputes will be resolved in the courts of the State of Montana, USA.

If you are a consumer in the EU, EEA, or UK, nothing in this section removes rights or remedies that you cannot legally waive, including the right to bring a claim in your local courts.

By using Turnsday, you consent to receiving electronic communications from us relating to your account and use of the Service. These communications may include account-related notices, billing and payment communications, security notices, service updates, birthday reminder emails you have configured, and other communications necessary to provide the Service.

Turnsday does not use your account information to send general marketing emails unless you separately consent where such consent is required.

We may provide notices through the Service, by email, or by other reasonable means. You are responsible for keeping your account email address accurate and accessible. For questions, legal notices, refund requests, or support, you may contact us at contact@turnsday.com.

You may not transfer or assign your rights or obligations under these Terms without our prior written consent, except where such restriction is prohibited by applicable law. Turnsday may transfer or assign these Terms in connection with a merger, acquisition, corporate reorganization, sale of assets, or similar transaction.

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in full force and effect.

Our failure to enforce any provision of these Terms does not constitute a waiver of our right to enforce that provision in the future.

These Terms, together with our Privacy Policy and any additional terms expressly incorporated into the Service, constitute the agreement between you and Turnsday regarding your use of the Service. If there is a conflict between these Terms and a specific additional term presented to you for a particular feature or purchase, the specific additional term will control to the extent of the conflict.
